By using this website or purchasing a product directly from ByJollyColostrum, you agree to these Terms and Conditions and any additional terms expressly presented for that product or service.

If you do not agree, please do not use the website or purchase its products.

1. About ByJollyColostrum

ByJollyColostrum (BJC) is an independent creative enterprise involved in publishing, writing, film, video, music, software development, website design tools, narrative development and related creative activities.

References to ByJollyColostrum, BJC, we, us or our refer to the operator of this website and associated BJC activities.

The website may offer products for direct purchase as well as products supplied by independent retailers and distributors.

2. Use of This Website

You may use this website for lawful personal, informational and commercial purchasing purposes.

You must not:

  • Use the website for unlawful, fraudulent or malicious activities.

  • Attempt unauthorised access to its systems, accounts or servers.

  • Interfere with website operation or security.

4. Books and Published Works

ByJollyColostrum publishes, promotes and distributes books and other creative works.

Descriptions, excerpts, cover images and promotional information are provided to help readers understand those works.

Availability, editions, formats, prices, shipping and delivery may vary between retailers and countries.

Information on this website does not guarantee that a particular edition or price will remain available from a third-party retailer.

5. Purchases Through External Retailers

Some products, including printed books, may be purchased through Amazon or other independent retailers.

When you follow an external purchasing link, the transaction is completed through the relevant retailer unless expressly stated otherwise.

That retailer is responsible for its payment processing, applicable charges, fulfilment, delivery, returns and customer service.

Your purchase is subject to the retailer’s applicable terms and policies, together with any non-excludable consumer rights.

6. Direct Purchases from ByJollyColostrum

Certain products are sold directly through the BJC website using WooCommerce and supported payment providers.

These may include:

  • WordPress plugins and software.

  • Software design packs, templates and extensions.

  • Digital creative products.

  • Other downloadable products introduced in the future.

Product descriptions identify what is included in each purchase.

Prices are displayed in United States dollars (USD), unless otherwise indicated. Any applicable taxes, charges or currency conversion amounts will be determined and disclosed as required during checkout or by the customer’s payment provider.

Payment processing is handled by authorised third-party payment services, including PayPal where available.

An order confirmation acknowledges receipt of an order. We may decline or cancel an order where payment cannot be verified, fraud is reasonably suspected, a product is unavailable or a material pricing error has occurred, subject to applicable law. Any payment collected for an order we cancel will be refunded as required.

7. Digital Product Delivery

Digital products are supplied electronically.

After successful payment confirmation, customers will normally receive access to their purchased downloadable files through WooCommerce.

Download links may be provided in order emails, on the order confirmation page or through the customer’s BJC account where available.

Some products also require a separate software licence key, which may be delivered by email and recorded against the purchase.

Customers are responsible for supplying a valid email address and maintaining access to it.

If a download link or licence email is missing, customers should check their spam folder and contact BJC for assistance.

We may provide replacement download access where reasonably necessary to fulfil a valid purchase.

Digital delivery does not involve physical shipping.

8. BJC Software Licensing

Unless a particular product expressly states otherwise, purchased BJC software is supplied under a limited, non-exclusive, non-transferable-to-third-parties licence to use the software in accordance with these Terms.

The customer purchases the right to use the software, not ownership of its source code, copyright or intellectual property.

8.1 Perpetual use

A purchased perpetual software licence permits continued use of the licensed version of the software without requiring an annual repurchase.

The end of an update entitlement does not, by itself, terminate the customer’s right to continue using the software.

8.2 Website activations

Unless otherwise specified, a standard customer licence permits:

  • One production website activation.

  • One staging or development website activation associated with that production website.

A customer may transfer an activation to a replacement website using the available licence-management process, subject to the applicable activation limits.

Additional production websites require additional licences unless a product expressly provides otherwise.

8.3 Updates

A standard software purchase includes access to eligible software updates for 12 months from the licence issue date, unless the product description states otherwise.

After that period, customers may continue using their existing licensed software.

Access to further updates may require an optional renewal or another arrangement clearly disclosed by BJC.

Renewal does not automatically occur unless a recurring payment arrangement has been expressly offered and accepted.

8.4 Licence verification

Licensed products may communicate with the BJC licensing service to validate licences, manage activations and determine update eligibility.

The licensing system is designed to permit continued operation during temporary licence-server outages.

A temporary inability to contact the licensing server does not, by itself, revoke a valid perpetual licence.

8.5 Service retirement

BJC may eventually discontinue a software product, update service or licensing server.

Where reasonably practicable, BJC intends to provide advance notice and a means for existing customers to continue using their legitimately purchased perpetual software without dependence on an indefinitely operating licence server.

Discontinuation of updates or licensing infrastructure does not, by itself, extinguish an existing perpetual right of use.

These provisions do not guarantee that software will remain compatible with every future version of WordPress, PHP, operating systems or third-party software.

9. Software Design Packs and Extensions

Some BJC products are extensions, design packs, templates, frames, layouts or other supplementary resources intended to operate with a separate BJC Core product.

A design pack may not require its own individual licence key, but it may require an installed and appropriately licensed Core product to function.

Purchasing a design pack does not automatically include the Core product unless the product description expressly states otherwise.

Customers should check product requirements and compatibility information before purchasing.

10. Software Installation and Compatibility

BJC software is developed for the environments and applications identified in the relevant product documentation.

Customers are responsible for checking the stated requirements, including supported WordPress versions, editors, PHP versions and any required Core products.

We recommend maintaining current website backups before installing or updating software.

BJC will make reasonable efforts to identify and correct reproducible software faults within the scope of any support or update entitlement provided.

However, compatibility with every theme, plugin, hosting configuration, browser or future third-party update cannot be guaranteed.

Software should not be used in safety-critical or other high-risk applications unless expressly identified as suitable for that purpose.

11. Software Support and Updates

Any included support period, support scope and update entitlement will be described in the applicable product information.

Support may include reasonable assistance with installation, licence activation and reproducible faults in
